CIRCULAR: 66-09 Ref: RATE OF PAY FOR EMPLOYEES IN TRANSITION

Dear Traincrew,
In June 2009, QR undertook a review of their policy that prescribes the rate of pay for employees in transition (“EIT’s”). It was during these consultation meetings that the AFULE strongly pursued the full flat rate for EIT’s. QR disputed this position.
After exhausting the dispute resolution process, the AFULE lodged the matter in Fair Work Australia. After two conferences before Fair Work Australia, the following is the outcome.
1) An EIT covered by the traincrew agreements will be guaranteed payment of eighty (80) hours per fortnight at the Full Flat Rate as provided by those agreements for a period of six (6) full fortnightly pay cycles from the first pay cycle after being declared an EIT.
2) After the six (6) full fortnightly pay cycles have expired, an EIT is entitled to payment of eighty (80) hours per fortnight at the Full Flat Rate as provided by those agreements for an additional period of thirteen (13) full fortnightly pay cycles should:
a) They not receive a full time permanent job offer for a position contained within the traincrew agreements; or
b) They not receive a full time permanent job offer in QR Limited, QR Network Pty Ltd or QR Passenger Pty Ltd, outside the coverage of the traincrew agreements,that is reasonable alternative employment.
At the conclusion of the period of thirteen (13) full fortnightly pay cycles, the EIT will reduce to 75% of the Full Flat Rate or base rate of pay (whatever the greater) even if they have not received any offer pursuant to points a) and b) immediately above.
